performH2O Affiliate Terms & Conditions

Effective Date: April 2025

1. Eligibility and Enrollment

Affiliates must be at least 18 years old and possess the legal capacity to enter into binding agreements.
Acceptance into the performH2O Affiliate Program is at the sole discretion of performH2O.
Affiliates are required to provide accurate and complete information during the application process.

10% Off for Your Crew: Share a 10% discount with friends and followers on one-time purchases through your unique referral link.
Subscription Savings: Subscribers referred through your link receive 15% off plus 50% off shipping on recurring orders.
10% Commission on Sales: Earn 10% of every sale generated through your referral link.
30-Day Referral Cookie: Receive credit for purchases made within 30 days of someone clicking your referral link.
Content & Creative Library: Access a variety of promotional materials, including logos, photos, and videos, to assist in promoting performH2O.
Automatic Payouts: Commissions are automatically disbursed once the minimum payout threshold is met.

Affiliates are strictly prohibited from bidding on performH2O brand names, trademarks, or any variations thereof on search engines, including but not limited to Google Ads.
Utilizing perfornH2O trademarks in paid search advertisements, including display URLs, is not allowed.
Violation of this policy may result in immediate termination from the affiliate program.

Affiliates may not resell performH2O products on third-party marketplaces such as Amazon, Walmart.com, eBay, Etsy, or any similar platforms.
Unauthorized resale on these platforms constitutes a breach of this agreement and may lead to termination.

Affiliates must adhere to performH2O's brand guidelines and represent the brand accurately and professionally.
All promotional content must comply with the Federal Trade Commission (FTC) guidelines, including clear disclosure of the affiliate relationship (e.g., using hashtags like #ad or #sponsored).
Affiliates are prohibited from making false or misleading claims about performH2O products.

Affiliates are granted a non-exclusive, non-transferable license to use performh2o's trademarks and promotional materials solely for the purpose of promoting performH2O products.
Affiliates may not alter or modify any promotional materials without prior written consent from performH2O
Upon termination of this agreement, affiliates must cease all use of performH2Os intellectual property.

Affiliates may receive confidential information from performH2O, including but not limited to marketing strategies and product information.
Affiliates agree to maintain the confidentiality of such information and not disclose it to any third parties without prior written consent.

Either party may terminate this agreement at any time, with or without cause, by providing written notice to the other party.
Upon termination, affiliates must remove all performH2O promotional materials and cease all promotional activities.

performH2o shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the affiliate program.
Affiliates agree to indemnify and hold harmless performH2O from any claims, damages, or expenses arising from their participation in the program.

This agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

performH2O reserves the right to modify these terms and conditions at any time.
Continued participation in the affiliate program constitutes acceptance of any changes to the terms.
